Sign up for this one everyone...if you want your PII premiums to go through the roof...of the house you find the 'vendor' did not in fact own. Plus the purchaser's mortgagees will be getting their snouts in the trough, too. So a house purchased for £500,000 with the aid of a mortgage of £400,000 which turns out not to be owned by the 'vendor' will lead to a £900,000 claim.

And don't forget, since Mishcon, the High Court does not consider breach of contract, nor negligence, as grounds for liability...the 'neighbour principle' now just boils down to 'who has insurance cover here?'
