Dominic - there is the key.

The likelihood is that all whiplash PI claims will be funded by BTE, which is likely to go up in order to facilitate the funding of so many claims. More profit for the insurers - and you'll get the hard sell when taking out the premium because you wouldn't want to be left on your own when you're involved in a non-fault accident would you now?

So of course now the would be Claimant will simply be directed by their insurers to the insurers' panel solicitors, who take the work on a low, agreed fixed fee and where they are owned by the insurer further line the insurer's own pockets.

Now both sides of the Claimant/Defendant divide will be thoroughly locked up by the insurance industry, which has now had a big uptick in take-up of one of their products (BTE) which itself has just got a lot more expensive.

This is not just a big win for the insurers. It's a win within a win within a win.
