For individuals the fines historically are:

Patel £7,500
Fuglers £5,000 (for one partner) and £20,000 (for another)
Norman £10,000

So Clyde & Co’s £10,000 per partner reflects the earlier decisions.

Fuglers as a firm were fined £50,000 i.e. the same as Clyde & Co.
The SDT will have considered the sanctions guidance, previous similar cases and the means of the parties.

The sanction here does not reflect the “big” firms get off perception of commentators.

Having advised numerous firms and individuals on the issue the best outcomes are those that’s do not make it to a SDT prosecution because an outcome is secured which is preferable and the publicity less.
