BTE can be okay on very straightforward, small value cases, but it has serious limitations.
The BTE insurer does not actually indemnify the Claimant's legal costs. They often provide piecemeal authority to expend another £x , despite having been told that such an approach is unworkable and contrary to the policyholder's interests. They interfere unduly in the running of cases. They of course take advantage of the regulations to insist that panel firms are used (with no quality control on panel membership), invariably the client being represented by a firm at the other end of the country and by a solicitor that they will never see.
No policyholder has ever had the scope of their BTE cover explained to them when they took the policy out, many don't even know the cover is there, so cannot have agreed to signing their freedom to instruct away!
