I suspect the reason in part for the delay on the insurer’s side was that in recent years the insurers were simply swamped with a tsunami of fraudulent whiplash claims
I understand from one insurer that before fixed costs were introduced claimant’s solicitors were making £10,000 to £20,000 on a simple whiplash claims and there was a genuine fear of meltdown and it was only returns on investments that kept them afloat.
