This is an astonishing observation from an experienced lawyer. Yes, torture is worse than knowingly soliciting false evidence. But there was no torture. And if Shiner and others had done their job properly this would have been clear much earlier and soldiers defending themselves against malicious and false allegations would have been spared a quite unnecessary ordeal. Stafford Smith seems so sure that British soldiers have tortured prisoners that he is prepared to let the end he believes in justify the means.
