This may be a pedantic and unhelpful point, but a question arises in my mind.

If the judge considers allowing future cross examination in these circumstances to be inconsistent with his judicial oath and his responsibility to ensure fairness between the parties, are we to understand that his having allowed it in the present case amounts to a breach of his oath, and an abdication of his responsibility? I'm not sure how else to read that comment.
