If this failure had damaged their own clients rather than other people they would be rightly sued for professional negligence. I really think Day should shut his mouth and see how he might go about making the world a better place rather than basking in the vainglory of what must in the general scheme of things be viewed as a hollow victory. Yes the outcome went someway to preserve his professional standing but it does not alter his disgraceful utterances in 2008.
