A Part 36 is suppose to have teeth. Both the the Claimant and Defendant should suffer a penalty for accepting a Part 36 after the relevant period has expired. There should be some consequence if you cause the other side to continue to incur costs because you do not know what your client's case is worth and you fail to accept a reasonable offer. I am not sure if it is indemnity costs but it as least standard costs plus the fixed costs of whatever stage you are at.
