There is a viable argument to be made for fixed costs (although in practice they are likely to be unfair to one side or the other depending whether the cost of the work is under or over the fixed fee). What is wrong is the setting of fixed fees at such an unrealistically low level (as in RTA whiplash cases) that the victims cannot obtain competent legal representation.
