I am pleased that the Law Commission has finally got round to publishing its proposals for consultation. The current 12th work programme was announced in 2014 and it has taken all this time just to get to a consultation document.

I am pleased that there are plans for a statutory capacity test and guidance, which should hopefully reduce the number of claims for lack of testamentary capacity and also help practitioners.

The issue of electronic wills is an interesting one and it is attracting most of the headlines, but we will have to ensure that appropriate safeguards are in place. I seem to recall in a lecture in the last 12 months about a case in Australia where a man who died made a will on his iPhone.

Also, there are plans to allow video and audio evidence - it reminds me of the 1980s comedy film Brewster's Millions, where the eccentric millionaire recorded a video to be watched after his death.
