There is a lot at stake with Wills. So maybe it is worth giving my anecdotal evidence. (i) I have come across instances where we've wondered if the Will was false.

(ii) I have come across instances where Wills have gone missing.

(iii) I have come across instances where people have been disinherited. All too often, although not always, it is children from a first marriage in favour of the second wife. It isn't that the children have needed the money, (they are often middle aged and doing fine), but neither has the second wife been exactly slumming it.

Those are the problems that I have had, and still have, to face. Making Wills easier / cheaper is not the problem. Wills are cheap and easy enough to do. With all due respect to those who disagree with me, I think that we need to tighten up on our procedures ... a lot. Not just a little bit, but a lot.

We also need to discuss whether the 1975 Act is really good enough. In countries where there are obligatory heirs the general population has a good idea of what they are entitled to. Is that really the case in England & Wales under the 1975 Act? I don't know what reasonable financial provision means ... and I do Wills & Probate for a living.
