I fell foul of the "2 witnesses present when the testator signs and in presence of each other". I sent mutual wills to the testator and his partner by post - they returned apparently properly executed but it transpired the testator signed his at breakfast and told his partner to get her witnesses to sign his Will as well when she went to work. The testator's son investigated and was able to set aside father's will although it was clear what father wanted. The case was heard in court and I was criticised for NOT writing back to the testator/rix asking for confirmation of the correct witnessing procedure. Could this technicality be moderated by new legislation?
