I would simply add to anon 13.55's excellent example that one may also deal with defendant representatives who have a tendency to:

- deny negligence in the face of internal reports stating that wrongdoing has occurred and that the patient has suffered as a result;

- delay disclosure of medical records and aforementioned internal reports;

- make stupidly low offers of settlement;

The consequence in fixing costs according to value is that the specialists cannot do it profitably. The work will be done by unqualified people on low salaries to be profitable, and it will have to be done in bulk.
