There is an interesting and encouraging exposition of the principles of the rule of law in paragraphs 66 to 77 which are worth a read (not least by those in the MoJ: they might just learn something).

The judgment outlaws these regulations - it does not preclude the introduction in the same way (by order, not legislation) of a more rational and necessarily lower cost fee structure: they don't need legislation as suggested. Politically that may be difficult, though - it would still need approval by the Commons and Lords which may become problematic.
