It's not the first time a court has made such a decision in relation to court fees. In R v Lord Chancellor, ex parte Witham [1998] QB 575 [27], the court ruled that the effect of the level of Supreme Court fees where there was no access to legal aid was to ‘bar absolutely many persons from seeking justice from the courts’. History continues to repeat itself. Hopefully, this decision will be followed by many others where similar situations apply.
