Strictly yes, sadly the client does not recognise a conflict of interest in the same way and just "trusts" the estate Agent, the Mortgage Broker, the Developer (need I go on) to be making a good referral. The clients do not understand that there are referral fees passing hands and frequently opt to use the referred firm. Law firms that refuse to accept referral fees and are therefore independant, are frequently "shunned" by such referers and clients are "persuaded to use the firm that pays the highest referral fee. They are all getting away with it despite the anti-bribery act and because the Law Society/SRA won't outlaw referral fees in conveyancing
