Lack of integrity on the part of conveyancers is the problem. Once a firm has made "initial comments" on draft documents to a developer and effectively barred themselves from noticing any other problems overlooked the first time round, the problems begin. Furthermore it is very unhealthy to have the same firm acting on all matters affecting one development, as a fresh pair of eyes can often notice mistakes missed by the original firm to look through the documents and there is no awkwardness in pointing these issues out. Developers should not be allowed to "co-erce" or "incentivise" buyers to use specific firms because it is my firm belief that this prejudices the buyer's position. I have seen the results of these practices too often leading to pretty disastrous consequences for buyers. I have been asked by developers to be the "go-to" conveyancer on plot sales on a number of occasions. When I have explained my terms for doing this (which emphasise my freedom to advise my buyer client freely on the basis of what is in the buyer's best interests and without any interventions by the developer) the developers invariably decide to seek their "go-to" patsy elsewhere and leave me, heaving a huge sigh of relief.
