If the bands & figures are adopted as proposed, it dramatically increases the amounts payable in off-Portal RTA claims. Should we expect a profession return swing to those case types? Indeed, does not the inclusion of off-Portal RTA cases in Band 3 of complexity, undermine the proposed Civil Liability Bill forcing up-to 2 year whiplash claims into the Small Claims Track?

Interesting how it is proposed banding holiday sickness claims with Portal RTA claims. Such suggests those providing the figures have never run holiday sickness claims; it would be interesting to know if they came by the figures, because they act for one of the tour operators in opposing costs?
