Despite the case management order, the limitation position may not be so straightforward.
The text of the order provides for a stay of all claims and applications relating to the Unison decision in the SC.
so that would cover both existing cases and new claims. This probably means that it is possible to issue new claims and so does not stop the limitation clock. I recall the same arrangement was made in the large-scale equal pay claims.
I must say that it seems a bit harsh to expect litigants to hurry up and make their claims just so they can be parked at the MOJ's convenience. Indeed, isn't it piling one denial of access to justice on top of another?
