Absolute disgrace - I have little doubt that the reason the undertaking was given prior to judgment was to avoid an order for repayment of the fees, which must have followed had there not been such an undertaking. Now the department is clearly intent on a little re-interpretation, not necessarily in the format that might have seemed appropriate to the supreme court.
