The "confessor" could very easily be the COLP or COFA, there's no reason to have a separate position just for that in a small firm. Some firms do implement this type of thing, whether it be full time or one every 6-12 months; if it avoids problems being buried it can only be a good thing.

In terms of the solicitor in question here; she's very lucky. The fact that she was wise enough to confess before signing a statement of truth probably saved her. I agree with others both in terms of her being given a second chance (It sounds like that's the right outcome), but also in terms of the inconsistency in decisions from the SDT. Most of the time, cases like this, where fee earners have similarly become 'tunnel visioned', no mercy is shown.

I am certain that the solicitor hiring Ben Hubble QC and obtaining expert evidence played a part in the SRA dropping the dishonesty charge.
