I still remember the day in 1956 when I had to prepare my first trial bundle. Only documents "relavent to the issues involved" were allowed in. I had to explain what those issues were and why the document was relavent. The managing clerk responsible for my training stood over me while I explained to him why I was including a document in the bundle. Only when I had satisfied him that I knew what to do did he report to the partners that I was competent and only then was I allowed to prepare a trial bundle. In those days judges punished excessive bundles. In those days judges knew what was supposed to be included because they had received the same training I had received. Unfortunately that has not been the situation for many, many years. There is a very simple solution to the problem. The judge picks up the bundle and issues the magic words "You don't obey the rules so you don't get paid" and puts the bundle in the bin.
Solicitors and clerks would soon learn how to prepare a bundle.
