No need. There's already a right to legal aid under Article 6 of the ECHR in both civil and criminal proceedings, see Airey v Ireland (1979).

Going further back, there is a clause in Magna Carta provides that "we will not deny or defer to any man either Justice or Right". It was this provision which the Supreme Court cited in its decision in July regarding employment tribunal fees.
