This is pathetic. There can be little trust in the judiciary to protect us - witness the variable range of judgments from judge to judge: it's called 'litigation risk'. Jackson's statement is no more than an empty promise, because he cannot and will not be able to fulfill it. The only worthwhile protection would be on a statutory footing, but it is hard to see how the provisions could be drafted in a way to account for all those grey areas, mentioned below, where the solicitor may come under a duty of care outside the 'bundled' retainer.

I would not, for one, touch unbundled services. I can only imagine the hike in PII premiums for those that do. Good luck!
