I used to support ADR. But my experience of it in practice has changed my mind.

It can readily be used by unscrupulous defendants to create delay and run up costs, in an attempt to sap the will of the claimant to fight on.

The courts are there to resolve disputes. They should do so as quickly and efficiently as possible. If the parties wish to negotiate they are free to do so. They may even be encouraged to do so. But compulsion, including imposing financial penalties, is wrong in principle and in practice.
