Do not agree Anon 17.50.

Defendants have plenty of reason to lie and it is a financial gain for an insurer if it can make a claim go away by raising the Claimant's risk so high that proceeding is not financially sound.

Also, if a claimant acts dishonestly it can be less than fraud. You have hit the nail on the head with regards to how insurers mistakenly view these claims. If all dishonesty was fraud FD would not exist at all and on all occasions a finding of FD would result in a finding of fraud.

I receive Defences, signed by solicitors, on behalf of insurers, which are routinely dishonest and there is absolutely no consequence for the people making stuff up to throw at the Claimants. There ought to be parity on this point.
