If fees are to be reintroduced, despite the trouncing the government has had at the hand of the Supreme Court then it should be noted that any attempt to shift the burden of costs to a Respondent in such proceedings, to enable it to defend itself is only likely to result in the same challenges in reverse. This 'balance striking' needs to be better thought out, next time.
