'Mulsanne made an application for a finding of fundamental dishonesty and the case went to Birmingham County Court, where deputy district judge Dickinson ordered the claimant pay the insurers costs on the indemnity basis, assessed at £12,754.'

So no note of whether there was a finding of fundamental dishonesty, the article states that the matter was struck out for failing to comply with directions, so QOCS protection would have been lost anyway.

The different accounts of the numbers of occupants, and who was driving, sounds like sloppy work completing the CNF's.
