I've got no sympathy for this particular LiP. The rule about email service is clear. All he had to do was read it and comply with it - it's not rocket science.

There are good reasons for not allowing service of proceedings (or anything else) by email. I don't always put my 'out of office' on because I'm often out unexpectedly. If I know the oppo, and know they're not going to take the p*ss, I will usually agree to accept things if they ask me in advance, so I know it's coming, but I wouldn't take that risk with an LiP.
