Outcome 11.1 in the 2011 Code of Conduct says "you do not take unfair advantage of third parties in either your professional or personal capacity" and Indicative Behaviour 11.7 refers to "taking unfair advantage of an opposing party's lack of legal knowledge where they have not instructed a lawyer." We have to sometimes deal with LiPs differently than where we have a solicitor on the other side. It's a fact of life. Hope that the decison does not lead to the dumbing down of the CPR.
