I am on some level surprised this one has got so far.

We do not accept service of documents by email in our office but in general the bigger defendant firms are either ignorant to the rules or simply do not care. The feeling among my colleagues when we are served incorrectly is "well what are you going to do about it?"

I'm not aware of anyone who has actually applied to strike out a defence or statement on the basis that it was served by email for the very reasons highlighted by other posters below. I can't imagine a judge giving us the time of day were we to suggest "we have received the document, but we don't like how it was sent to us."

Also, with the time it is currently taking the courts to do anything you would probably have had a trial by the time the application hearing is listed.
