CPR 3.13 "Unless the court otherwise orders, all parties…must file and exchange budgets…not later than 21 days before the first case management conference.”

Key words being " unless ordered otherwise..."

The parties were "ordered otherwise" therefore the usual 21 day requirement is disapplied.

Seems like the claimant tried to take a tactical advantage when they should have acted with a little more common sense
