For those who don’t know there is already an Advocate quality scheme in place.
Admittedly it is ad hoc.
Here’s how it works: poor advocacy by barrister-gently reminded what to do and how to do it; quiet chat with head of chambers or word I the ear at Bar Mess.
Poor advocacy by solicitor-ridiculed in court in front of client and everyone else.
If any Judge or Magistrate has any concerns then all they have to do is make a report to the BSB or SRA. It really is that simple.
The only real solution is a College of Advocates of which all advocates (ie anyone who for fee or pro bono undertakes the representation of a party before a Court or Tribunal) must be a member to appear in Court or before a Tribunal which will organise training and discipline and confirm the licence to work at defined grades of each Advocate. This will address the concerns and not be a tick box nonsense-like CQS and other quality assurance schemes.
