The Portal is an online claims communication system between the insurer and solicitor, therefore we do electronically sign and submit the CNF on behalf of the Claimant, with instructions provided by the client.

As a firm we send a draft CNF to the Claimant for them to approve before we submit, as the statement of truth confirms that the Claimant believes the content to be correct. This may be a cautious approach and could delay submission compared to other firms processes, but it seems justified in light of this decision.

With the proposed claims reforms, the reasoning "it's a low value case, we don't get paid much, therefore claims are processed" is unlikely to win much favour with the MOJ, ABI or SRA, who expect a 5-star service to be maintained.
