Damages for injury is centuries old hence the right to damages today. That is why I think compensation is due.

You do not understand the JCG. They are a guide only and it is very rare indeed that an injury precisely fits a specific guideline. Most injuries fall within a bracket but then you’re into the realms of precedent. It still amazes me that insurers quote a 10% increase when they haven’t even allowed for the general increase over time.

If you think the court is going to decide quantum in the vast majority of cases then bully for you. The reality is that the vast majority of cases won’t get anywhere near a court.

With no representation claimants aren’t going to go anywhere near the court system unless they are particularly feisty or adept.
