How does the court’s refusal of copies of such documents sit with the data access provisions of the DPA? It seems to me that the Firm are a data controller, that holds the client’s personal data and therefore the clients could simply make a DPA request which could then be enforced by application if not forthcoming. The COA has said that parties can make DPA requests pre action or even during proceedings. Any thoughts would be welcome...
