2. Questions about rights of audience of unqualified costs draughtsman under LSA 2007 (not yet resolved).
3. Questions about what prompts 'hundreds or thousands' of PI litigants to pursue such claims, in some (many?) cases 2 years after they have had their damages (even, it appears, without deduction in some cases - so what are they on about?)
4. Questions about how these claims are harvested, how it is that the claimants all instruct one firm of solicitors and one (or two?) firms of costs draughtsmen apparently without overt marketing (not yet resolved).
5. Questions whether this involves cold calling - prohibited for solicitors, not expressly prohibited for costs lawyers regulated by the Costs Lawyers Standards Board or not, unless contravening Privacy and Electronic Communications Regulations/Data Protection Act/breach of confidentiality (perhaps)/general law (not yet resolved).
