I was speaking to a paralegal from the fraud department of another big northern player last week. Her job is to process incoming referrals from insurance companies before they are allocated to the fee earner to draft the Defence. She was candid enough to tell me that the files that are referred by the insurers are marked as fraud and are required to be defended on that basis. The decision is made at insurer level, without any legal oversight whatsoever. Irrespective of the merits or the evidence, the insurer sets the fraud hare running, and that particular firm are not able to say 'We don't think you're on to a winner here'.

Can I ask whether Keoghs' "healthcare-enabled fraud team" is similarly bound by their clients?
