As a solicitor practising in PI and a little Clinical Negligence, I would welcome some certainty from the government.

My suggestions:-
1) Ban all cold calling
2) Ban all advertising, save for that carried out by law firms (so, unless you have an SRA number, you cannot market to clients)
3) Extend Medco to all PI & Clin Neg
4) Extend the requirements placed upon external accountants/auditors in relation to reporting breaches of accounting rules to include a simple report that must be requested from a firm's bankers.

If these were adopted, clients would come direct to the profession, commissions would be removed from all of the usual hangers-on and the money made out of this work would stay where it should, with solicitors!

It the additional information was requested from the auditors/accountants and the firm's bankers and this information was disclosed every year to the SRA, many disasters could be avoided and we would stop reading about "solicitor struck off for financing cashflow with unpaid counsel fees" and the like.
