If I was Mishcon's insurer I would be looking for indemnity from the other solicitor's insurer - it has been gospel from the inception of MLR that a regulated firm must KYC, and any firm it is dealing with can rely on that without making further enquiry. That doesn't really help, because the PI insurers as a whole are still bearing the cost of the fraud. A novel idea - why doesn't the Land Registry issue a physical document, let's call it a Land Certificate or Charge Certificate, the absence of which puts us all on enquiry?
