Absolutely fair and right. I had always thought the caveat about genuine attempt to settle was wrong and should be reviewed by the Rules Committee, since it creates uncertainty, as we have seen in this case. The whole point of a Claimant’s part 36 offer is to encourage Defendants to settle and thereby save Court time. If Defendants don’t take offers seriously when made, they have only themselves to blame.
