Anyone who thinks that this sort of thing, or lack of disclosure only affects big cases or rape cases is deluding themselves. I can think of 2 straightforward cases that I dealt with in the last couple of years where material crucial to the defence was not disclosed.

Case A - where the prosecution were ordered to disclose the material, the police refused to agree and the case was discontinued.

Case B - the material that had not been disclosed was obtained from another source. I had been asking the prosecution to disclose it for 8 months. The case was withdrawn on the day of trial.

And, that's only the cases where they were caught out. I dread to think how many there are where I didn't actually catch them.
