The message you should be getting should be written on size 9 Oxford Brogues. If one of my junior solicitors was handling cases in that manner I would be having a serious chat without coffee.

You are costing your insurer client money and on a leakage audit you would get flayed.

The approach by some Defendant solicitors is nothing short of inexplicable, why would you allow a claim to proceed to the next stage of fixed costs to save £200 in damages when the increase in the fixed costs is £600 + VAT?

If you think your Part 36 is costs protective, sit back and roll along to a trial, after all you're not dealing with a 100% uplift on hourly rates are you?
