To all those that say this is why you should have professional legal representation, I am still of the view that promoting or marketing solicitors on the basis that we can comply with procedural rules (that the legal system itself put in place) is a bad strategy.

The real strength of lawyers is identifying the legal issues in the case, assessing the strength of the arguments and the evidence, getting parties (hopefully on both sides) to look at the issues more objectively, etc...

The judgment doesn't go into details, but my impression is that the underlying claim here was not a strong one. That is perhaps the most important reason that Mr Barton needed professional, independent advice and why it might have saved him a small fortune.
