Anon at 09:22: "I am staggered by the number of solicitors serving documents, especially witness statements, by email when my firm has never confirmed we will accept service by this method. If solicitors up and down the land are still getting it wrong what hope is there for LIP's."

You don't have to have stated that an e-mail address may be used for service if your e-mail address is set out on a statement of case or a response to a claim filed with the court: CPR4.1(2)(c). Of course, that couldn't be used to serve a claim form, but it can for statements.
