I think everyone would agree that there should be a Housing Court. This is not a novel idea; indeed it has been a proposal which successive Governments have ignored over the last 30 years. Having specialist Judges dealing with often tricky points of law has to be better than the current system. The problem that I foresee is the MOJ finding this a rather good excuse to take away Legal Aid for a broad swathe of work which is currently within scope. That will lead to Landlords being represented and tenants doing the best they can. That will represent inequality of arms and denial of Justice. Housing is such an important issue; some would say the most important issue. As such we should be slow to allow an infrastructure to develop which will be to the detriment of tenants.
