I would imagine there was probably a previous consistent exchange of email communications before things soured -thus the LiP made the reasonable mistake of thinking he could serve his papers that way. (how many times do lawyers serve a few days or weeks over time? My experience has been to expect them to be late.)

I would also imagine that if things were reversed and the lawyers had served by email -the court would have used the LiP previous acceptance of emails against him.

LiP could also be fooled by claims made by the courts of moving toward paperless courts or a desire to reduce the amount of paper needing to be printed.

I think the Court may have been more concerned about slapping down an uppity LiP trying to get some accountability within the legal profession -how ghastly.
