How does one advise the client that having been penalised on proportionality on assesment , when the paying party has appealed and the bill has been reduced again that one should lodge an appeal? The case I was involved in was one brought against my client's by a solicitor who raised a novel concept in law which had to be fully and robustly defended (arising from the parking ticket), on assessment the court officer took the view that there was too much work on documentation and that it was disproportionate. Perhaps what would be more sensible for Jackson would be to look at the cases which are being appealed at a lower level, read, inwardly digest and then open the window to see what the real world looks like. At the moment proportionality is used by individuals wishing to create huge and fanciful legal arguments which one has to defend knowing that because the taxing officer (a lowly paid civil servant) has no idea what things actually cost and that they consider it wicked that solicitors are making so much money.
