Unless the UK acknowledges continuing CJEU authority in relation to questions of EU family law, as applied to families within the UK jurisdictions, UK judgments may not be reciprocally recognised or enforced in the EU. This could cause problems in relation to divorce procedure, protection of children's rights, service of process and access to evidence from EU jurisdictions.

EU law does not prescribe substantive law for the UK, only uniform procedural laws in specified areas. Allowing harmonisation of such procedures to continue will save time and money. More importantly, it will reduce the scope for conflict between family members who are already going through a very stressful period.
